The Gurugram administration has frozen the bank accounts of 71 builders over ₹446 crore in unpaid HRERA dues, with property attachment proceedings also underway.
The biggest defaulters include Ansal Housing/Ansal Construction Housing with ₹91 crore outstanding, Raheja ₹90 crore, Vatika ₹80 crore, Parsvnath ₹74 crore, Ramprastha ₹57 crore, IREO ₹24 crore and ILD Millennium ₹8.59 crore.
Several recovery certificates have been pending for more than four years. If the dues are not recovered from bank accounts or attached properties, the administration may proceed with arrest and detention of the defaulters.
The action covers penalties and refunds ordered by HRERA, Gurugram. Under Section 40(1) of the RERA Act, 2016, such amounts are recoverable as arrears of land revenue.
Notices have been issued to the builders to deposit the outstanding amounts. Proceedings to attach movable and immovable properties have also been initiated under the Punjab Land Revenue Act, as applicable to Haryana.
Deputy Commissioner Uttam Singh said the administration would ensure that the money reaches the homebuyers for whom the recovery certificates were issued.
“The Authority does its part by penalising the builder, but so long as the recovery does not reach the homebuyer, the entire process remains toothless,” Singh said.
“The money will be recovered from the frozen bank accounts or the attached properties. If that fails, further steps under the Act would be taken, which may also lead to arrests. No builder will be allowed to sit over amounts that lawfully belong to the homebuyers,” he said.
The administration said recovery of HRERA dues had stalled in the past and the current action followed a review of all pending recovery certificates.
The Deputy Commissioner will review progress every week, while SDMs and Tehsildars have been directed to complete the recovery process in a time-bound manner.
Homebuyers with recovery certificates can approach the District Revenue Officer, concerned SDM or Tehsildar for the status of their cases.
